As the one-year mark since the U.S. Supreme Court’s TC Heartland decision passed, IP litigation counsel Andrew Radsch (Silicon Valley) discussed in Bloomberg Law’s Patent, Trademark and Copyright Journal the decision’s impact on patent litigation strategy.

While the Supreme Court’s TC Heartland v. Kraft decision did not apply to foreign defendants, Mr. Radsch notes that some plaintiffs have become more careful since the ruling to take advantage of the looser patent infringement venue rules for foreign defendants.

Separately, in a May 24 Law360 TC Heartland anniversary article, life sciences IP litigation practice chair and partner Filko Prugo (New York) was quoted on the increase in Hatch-Waxman patent infringement cases over generic drugs in the District of Delaware and strategic issues of multidistrict litigation for biopharmaceutical companies.
