Ropes & Gray Examines PTAB and District Court Outcomes in Biopharmaceutical Patent Reviews; Law360 Features Our Report

In a June 21 article, Law360 examined a Ropes & Gray analysis that involved an examination of all recent America Invents Act reviews of approved drug products. Our study determined that the Patent Trial and Appeal Board has been invalidating biopharmaceutical patents and roughly the same rate as District Courts, challenging a belief held by some that the PTAB is more likely to invalidate those patents. The article includes remarks from IP life sciences litigation partner Filko Prugo (New York), who authored the report.
