IP litigation partners Kevin Post (New York) and Matt Rizzolo (Washington, D.C.) co-authored an article published by Bloomberg Law that examines the PREP Act’s might help defend against COVID-related patent infringement claims. The authors explain that the little-known Public Readiness and Emergency Preparedness Act is a U.S. law that protects manufacturers from tort liability lawsuits in public health emergencies, and could be interpreted to include immunity from patent actions as well.
