To help fund managers simultaneously operating private equity and private credit funds, The Private Equity Law Report discusses risks to avoid when managing the funds in parallel. Asset Management Partners Jason Brown and Jessica Taylor O’Mary are quoted in the two-part article series.
This first article published on Nov. 3 titled “Simultaneous Management of PE and Private Credit Funds: Use of Walls and Other Tactics to Manage MNPI Risks (Part One of Two)” identifies several measures that can curb the internal spread of MNPI, with particular emphasis on whether and how information barriers (i.e., walls) can be used by managers.
The second article published on Nov. 10, titled “Simultaneous Management of PE and Private Credit Funds: Techniques for Properly Allocating Investments, Fees and Employees (Part Two of Two)” describes techniques for mitigating conflicts that can arise when allocating shared investment opportunities, expenses and employees’ time between a sponsor’s PE and private credit funds.
