Employment, executive compensation & employee benefits partner Doug Brayley participated in a point/counterpoint article in the Boston Bar Journal showcasing two differing perspectives on reforming the patient-psychotherapist privilege in employment discrimination litigation. Doug took the defendants’ position, concluding “Reform should ideally be carried out through legislative action rather than in the courts, given that much of the current uncertainty results from the unpredictable exercise of judicial discretion.”
