In Managing Intellectual Property, IP litigation partner Steve Pepe (New York) examines the significance of the Biden administration’s transfer of a 2020 supplementary letter on technology standards implementation to the competition advocacy section of the U.S. Department of Justice’s website. 

Steve explains that he does not expect the decoupling of the 2020 supplementary letter to change the strategies of standard-essential patent licensors and licensees. He notes that parties are still going to approach their negotiations in the same way and try to comply with the policies of the standard-setting organizations and the legal frameworks by the courts.
