A group of 25 Republican attorneys general sued Labor Secretary Marty Walsh and the Labor Department over a Biden administration regulation that gives retirement plan sponsors more freedom to consider environmental, social and governance factors when selecting investments.

In a Bloomberg Law podcast, Joshua Lichtenstein, partner and head of the ERISA and fiduciary benefits practice, said, “the allegations in the complaint are basically that the DOL’s current rule will have the affect of making it more difficult and more costly for plan sponsors to have to evaluate different investment options.”
