■The Office of Attorney General Doug Peterson released a 37-page report "to inform public policymakers and those who enforce the law in Nebraska about ESG to ensure that they understand the legal threats that it poses…[and] to provide awareness to the general public, much of which will be directly impacted by ESG practices.” The report flags what it deems key flaws of the ESG movement, namely that it lacks consistent metrics and ratings; its factors are often in conflict; its proponents do not practice what they preach; and it fails to deliver increased financial returns to investors. |

Promote Divestment from Certain Countries |
■ For any investments related to the retirement systems, the appointed members of the council shall not engage in investment activities with a restricted entity. Upon publication of the list of restricted entities by the State Treasurer pursuant to subdivision (10) of section 84-602, the appointed members of the council shall identify any holdings of the retirement systems related to any such restricted entity and shall divest from all holdings and other investment activity in such entity as soon as practicable. ■ A "restricted entity" means a Chinese entity that is (i) Designated by Presidential Executive Order 13959, 85 Federal 18 Register 73185, dated November 12, 2020, relating to addressing the threat from securities investments that finance Communist Chinese military companies; (ii) Designated by Presidential Executive Order 14105, 88 Federal 22 Register 54867, dated August 9, 2023, relating to addressing United States investments in certain national security technologies and products in countries of concern; or (iii) Included in the Specially Designated Nationals and Blocked Persons list maintained by the Office of Foreign Assets Control of the United States Department of the Treasury.

■Requires an investment fiduciary to discharge his or her duties in the interests of the participants in a public employee retirement system and their beneficiaries for the exclusive purpose of providing financial benefits and paying reasonable expenses for administering the public employee retirement system. Additionally, requires an investment fiduciary to take into account only financial factors when discharging fiduciary duties. ■ Originally introduced in 2023 as “LB743: Adopting the Investment Neutrality in Public Funds Act” but failed to pass during that legislative session.
