Health care partner Christine Moundas and associate Gideon Palte co-authored a Law360 article on the proposed changes to the Medicare Promoting Interoperability Program.

The authors note that these proposed changes have important and far-reaching ramifications for participating hospitals and other Promoting Interoperability Program stakeholders such as electronic health records developers. In addition to being held financially accountable to the Centers for Medicare & Medicaid Services, participating hospitals may find themselves accountable to patients, who may make decisions about where to seek care based, at least in part, on a hospital's Promoting Interoperability Program score. This increased transparency represents the continuation of a trend of federal focus on health IT interoperability and patient empowerment that appears likely to persist for years to come.
