In Bloomberg Law, Regina Sam Penti Analyzes Launch of European Unified Patent Court

In a Bloomberg Law article, IP transactions partner and solicitor of England & Wales Regina Sam Penti discussed the European Union’s United Patent Court, which is expected to make its debut in the next few months. 

Under the current system, companies with patent protection in Europe must enforce their patents in individual countries, each with their own body of law. The UPC is designed to migrate from the patchwork of national laws to a more cohesive framework. 

Regina explained that it’s important for all U.S. companies to know the UPC is effectively a “sea change” from an enforcement regime that is very complicated and costly to one with the hope of a single body of law, and companies that participate in the early days of court may be able to influence its jurisprudence.
