IP Litigators Discuss U.S. Supreme Court AIA Case

In an article published by The Recorder on Oct. 29, IP litigation partner Matt Rizzolo (Washington, D.C.) discusses the U.S. Supreme Court’s decision to hear Return Mail v. U.S. Postal Service, which will consider whether the government is a “person” who may petition to institute review proceedings under the America Invents Act.

Mr. Rizzolo is also quoted on the AIA case in an Oct. 30 Law360 article. He explains that the Supreme Court might be looking beyond the AIA. There are a number of other statutes that use “person” and do not clarify whether that includes the government.
