In Law360, IP Litigators Address Patent Cases in U.S. Court of Federal Claims

IP litigation partner Matt Rizzolo (Washington, D.C.) co-authored a Law360 article published April 15 examining patent cases in the U.S. Court of Federal Claims. The authors analyze a recent Court of Federal Claims patent infringement case against the United States government, Hitkansut LLC et al. v. United States.

In the case, the Court awarded the patent holder more than $4 million in attorney fees and other litigation expenses, marking the first time fees were awarded to a successful plaintiff under 28 U.S.C. 1498. The authors note that the decision might lead to increased interest in bringing patent claims against the government in the Court of Federal Claims.
