In Massachusetts Lawyers Weekly, Attorneys Evaluate New Federal Trademark and Copyright Laws

A Massachusetts Lawyers Weekly article discusses two new laws that were recently passed by the U.S. Congress, the Trademark Modernization Act of 2020 and the Copyright Alternative in Small-Claims Enforcement, or CASE, Act of 2020. 

In the article, IP transactions counsel Emilia Cannella (Boston) said she suspects that the Trademark Modernization Act may be just a starting point, to be followed by other measures to declutter the trademark register. 

The main effect of the CASE Act will be to create a new, alternative forum to give copyright holders a more efficient, less expensive way to pursue violations. IP transactions counsel Erica Han (Boston) notes that this will make it more attractive to bring copyright litigation for the small photographer or other individual whose rights have been infringed and who do not have the resources to bring a lawsuit.
