In a Law360 article, IP litigation associates Jolene Wang and Cole Dunn and IP litigation partner Steven Pepe (all of New York) analyze three proposals for Section 101 patent eligibility reform.

The authors explain that the proposals from U.S. Senators Thom Tillis, Mazie Hirono, Tom Cotton and Chris Coons, the American Bar Association and the American Intellectual Property Law Association are designed to expand patent eligibility while also adding predictability and clarity. However, it remains to be seen whether any of these approaches are ultimately beneficial or harmful to innovation.
