On April 3, the Delaware Court of Chancery awarded TravelCenters of America LLC (TA) approximately $10 million in legal fees, expert fees, and costs, with interest following its trial victory against Comdata, Inc in September 2017. The litigation began in October 2016 over fees charged by Comdata to TA for processing payments at TA’s locations using Comdata fuel cards. After extensive discovery and a four day trial, Chancellor Andre Bouchard of the Delaware Court of Chancery issued a 101 page decision ordering Comdata to honor TA’s contract terms and to reimburse TA for all excess amounts charged to TA since February 1, 2017, plus interest. The decision also required Comdata to reimburse TA for its reasonable attorneys’ fees.
A Ropes & Gray team led by commercial litigation partners Jane Willis, Matthew McGinnis, and C. Thomas Brown represented TA.
