In a Managing Intellectual Property article, IP litigation partner Dave Chun examined the increase in trade secret complaints at the U.S. International Trade Commission.
Dave explains that companies are turning to the ITC in trade secret misappropriation cases if they do not expect federal courts to hear their cases. He notes it can be difficult to get jurisdiction if the trade secret matter took place outside the U.S. Foreign companies may also turn to the ITC to take advantage of discovery rules, which can be more favorable than those in their domestic courts.
