In a Politico article, litigation & enforcement partner Chong Park commented on a conservative backlash against corporate sustainability initiatives and Republican state officials’ threats to file antitrust lawsuits against financial services companies over collaborative ESG net-zero greenhouse gas commitments firms have made through groups such as the Net-Zero Insurance Alliance and the Net-Zero Banking Alliance.
Chong said it would be a difficult legal case to make given some of the requirements to prove an antitrust case. He compared these net-zero industry groups to trade associations that warrant antitrust scrutiny but often do not produce actual collusive conduct that harms competition.
