In a Law360 article, health care partners Deborah Gersh and Jennifer Romig examined the recent White House executive order that directs federal agencies to develop frameworks for artificial intelligence (AI) regulation and to use their existing authorities to ensure responsible deployment of AI and AI-enabled technologies. The executive order places special emphasis on the use of AI in the content of health care and life sciences industries because of the risk of patient harm.
The authors note that businesses developing or using AI solutions should consider how to address the principles underlying the executive order. This can include establishing procedures for testing and ensuring human oversight of AI outputs, creating policies around identifying and recording errors, and developing methods for communicating needed product updates.
