In an article for Bloomberg Law, litigation & enforcement partners Doug Hallward-Driemeier and Rob Skinner discussed how the Supreme Court’s recent ruling on Chevron will impact Securities and Exchange Commission (SEC) enforcement across industries, and within the federal government and lower courts.
“Parties accused of violating statutory provisions in numerous contexts will now have a more level playing field in trying to convince a judge that their conduct comported with the best construction of the statutory provisions in question,” said Rob.
Doug added, “after today’s decision, lower courts will not apply Chevron, and will themselves need to grapple with the canons of construction to determine what is the best interpretation of the statute.”
