With the Securities and Exchange Commission (SEC) launching its first enforcement actions against AI-washing this year and signaling plans to ramp up scrutiny of AI practices in 2025, litigation & enforcement partner Amy Jane Longo shared her observations on regulatory trends in an article for Bloomberg Law. Amy observed that ongoing enforcement actions against AI-washing have been "low-hanging fruit," noting "they’re fairly straightforward cases that essentially say you can’t misrepresent how you’re using AI.”

Amy highlighted the potential continuity of enforcement actions under the second Trump administration, adding that “it naturally takes a fair amount of time for changes in priorities to percolate through the SEC bureaucracy, there are cases in the pipeline that are already authorized or pending, so I don’t think we are likely to see an immediate dramatic effect.”
