In a Harvard Law School Forum on Corporate Governance article, attorneys examined the U.S. Department of Labor ending its defense of the Biden-era ESG rule in a lawsuit brought by a coalition of state attorneys general and engaging in new rulemaking and rescinding 2022 guidance that expressed significant concerns with adding cryptocurrency to a 401(k) plan investment menu for ERISA plans.
