In a recent Lexology PRO article, litigation partner Alexander Simkin discussed the jurisdictions where companies could face heightened risk of greenwashing litigation.
Alex noted that New York and California are “at the forefront” of tackling greenwashing, and that litigation and regulatory enforcement is being led by state and local regulators. However, Alex also cautioned that “civil litigation risk extends well beyond those states as major companies can be sued anywhere they operate, and not just where they are headquartered or incorporated.”
