In a Global Investigations Review article, litigation & enforcement partner Emerson Siegle discussed three recent court rulings that scrutinize the Pentagon’s list of designated Chinese military companies.
Emerson explained that the Pentagon’s Chinese military company list is being wielded in new ways. “As the Department of War utilizes its newer designation authority more aggressively, you will see more challenges.” He noted that the number of challenges targeting Pentagon designations is also in part due to “the newness of the statutory authority, compared to the longstanding authorities of the Treasury Department’s Office of Foreign Assets Control (OFAC) and Department of Commerce’s Bureau of Industry and Security (BIS).”
