In a Law360 article, litigation & enforcement partners Amy Jane Longo and Rocky Tsai and associate Tristan Lim discussed the notable litigation, enforcement, and regulatory developments from California's financial regulators in the third quarter of 2026.
The authors discuss a 10-state challenge, joined by California Attorney General Rob Bonta, to Office of the Comptroller of the Currency (OCC) rules that would preempt state escrow interest laws. They also cover two California Department of Financial Protection and Innovation (DFPI) actions: a consent order against a mortgage lender over cybersecurity failures and orders requiring five broker-dealers to repay excessive commissions. Finally, they address the DFPI's opposition to proposed changes to the CAMELS bank rating system.
The authors note that institutions may need to follow the stricter California standard where state and federal requirements differ.
