In a recent AmLaw Litigation Daily Litigator of the Week article, a Ropes & Gray litigation team was recognized for securing a decisive appellate victory on behalf of Apax Partners, L.P. in one of the remaining lawsuits arising out of the 2006 recapitalization of Hellas Telecommunications.
On May 5, 2026, the Appellate Division of New York Supreme Court issued a 5-0 decision modifying the trial court’s decision and directing that the case be dismissed against Apax Partners, L.P. and other defendants in its entirety. The Court held that the plaintiff, Cortlandt Street Recovery Corp., “failed to state a valid fraud claim because it did not allege any actionable misrepresentations,” and also failed to state a valid breach of contract claim.
