Capital markets partners David Fine and Marko Zatylny, (both of Boston) co-chairs of the firm’s infrastructure/energy group, authored an article titled “Investing Your Way Into FERC Jurisdiction: A Warning to Compliance Officers and Company Counsel” in the Oct. 6 issue of Bloomberg BNA’s Securities Regulation & Law Report. The article explores the trend of financial institutions’ increasing appetite for investment in the energy sector and the compliance problems it may present for firms in the new era of the Public Utility Holding Company Act of 2005, by which these institutions may, unintentionally, fall under the jurisdiction of the Federal Energy Regulatory Commission (FERC) and its regulations.
