Private Client Group Partner Authors Article on Trust Decanting for Boston Bar Journal

Private client group partner Marc Bloostein authored an August 9 article published by Boston Bar Journal discussing Ferri v. Powell-Ferri, a case that concerns the expansion of common law “trust decanting” in Massachusetts.

Trust decanting is a method by which the trustee of an irrevocable trust distributes trust assets into a new trust with revised terms.

Mr. Bloostein writes that although the decision in Ferri provides needed guidance to trustees on decanting, it leaves some unanswered questions. He argues that the Massachusetts legislature should adopt a decanting statute to provide a path for trustees to decant with clear limits and safeguards.
