Intellectual property transactions partner Edward Kelly and counsel Regina Sam Penti (both of Boston and London) authored a Dec. 21 article in Law360 comparing the European Union and U.S. guidance on standard-essential patents (SEPs) which protect patented technologies deemed essential to an industry standard.
The authors address similarities and differences regarding the treatment of SEPs and the principles for licensing and litigating of SEPs.
