In Law360, IP Litigator Examines PTAB Motion to Amend Pilot Program

IP litigation partner Scott McKeown (Washington, D.C.) was quoted in a March 19 Law360 article on the potential benefits of the new Patent Trial and Appeal Board motion to amend pilot program. Under the new procedure, patent owners who file a motion to amend can ask the PTAB for preliminary feedback about the validity of the proposed amended claims. Patent owners then have the opportunity to revise their motion to amend.

Mr. McKeown explains that the pilot program is likely to help patent owners’ chances of success in amending patent claims, but he expressed doubt that motions to amend will ever become widespread in PTAB proceedings.
