For the first time, a U.S. Patent and Trade Office director will review a preliminary decision of the Patent Trial and Appeal Board to hold a trial under the America Invents Act. The move could impact a $2.18 billion jury verdict awarded last year against Intel. Scott does not expect the USPTO director to establish a firm rule against third-party challenges to patents that have resulted in big verdicts. He notes that some third parties have legitimate reasons to fear the patent will be asserted against them in the future.
