In Global Competition Review, IP litigation partners Kevin Post and Steven Pepe and IP litigation associate Lance Shapiro examined the key role that juries play in standard-essential patent litigation for infringement and damages.

The authors explain that while the legal framework of SEP litigation continues to evolve through executive policies, juries’ roles in SEP litigation has been confirmed to include findings of infringement and compliance with standards, as well as damages awards. Since the Federal Circuit has embraced an increasingly large role of juries in this area, juries will likely continue to have a major impact on SEP litigations.
