Debtor/Company-Side Experience:
- Represented Accelerate Diagnostics, Inc. and its affiliates in their Chapter 11 cases in the U.S. Bankruptcy Court for the District of Delaware, including a court-supervised sale of substantially all assets and a structured wind-down of remaining operations. *
- Represented Mondee Holdings, Inc. and certain of its affiliates in their chapter 11 cases in the U.S. Bankruptcy Court for the District of Delaware, filed to address approximately $250 million in funded debt through a court-supervised sale of substantially all assets implemented pursuant to a restructuring support agreement and investigate potential claims and causes of action. *
- Represented Dynata, LLC and certain of its affiliates in their prepackaged chapter 11 cases in the U.S. Bankruptcy Court for the District of Delaware which resulted in a 40% reduction of approximately $1.3 billion of debt and $81.5 million of new money financing. The case emerged from chapter 11 in five weeks.*
- Represented Unconditional Love, Inc. (d/b/a Hello Bello) and certain of its affiliates in their chapter 11 cases in the U.S. Bankruptcy Court for the District of Delaware, filed to address approximately $65 million in funded debt through a court-supervised sale of substantially all assets and the establishment of a litigation trust to pursue estate causes of action for the benefit of stakeholders.*
- Represented Clovis Oncology, Inc. and certain of its affiliates in their chapter 11 cases in the U.S. Bankruptcy Court for the District of Delaware, filed to address over $750 million in debt, facilitate two 363 sale transactions, and negotiate and consummate a liquidating chapter 11 plan.*
- Represented Global Brands Group, Inc. and certain of its affiliates in their chapter 11 cases in the U.S. Bankruptcy Court for the Southern District of New York, filed to address over $238 million of funded debt, facilitate multiple 363 sale transactions of various licensed brands, and negotiate and consummate a liquidating chapter 11 plan.*

- Represented secured lenders in connection with the heavily contested chapter 11 cases of PosiGen, PBC and its affiliates in the U.S. Bankruptcy Court for the Southern District of Texas.
- Represented ad hoc group of bondholders in connection with the out of court refinancing of Cooper-Standard Automotive, Inc., involving the issuance of approximately $580 million of new first lien debt.*
- Represented ad hoc group of senior noteholders in connection with the chapter 11 cases of The Hertz Corporation and its affiliates, representing approximately $1.14 billion of aggregate holdings of senior unsecured notes.*
- Represented independent director of Neiman Marcus Group LTD LLC in connection with their chapter 11 cases in the U.S. Bankruptcy Court for the Southern District of Texas, including conducting an investigation and negotiations that led to a global settlement and confirmation of the debtors’ plan.*
- Represented secured noteholders in connection with the prepackaged chapter 11 cases of Northwest Hardwoods Inc., restructuring $379 million of secured notes for takeback debt and equity.*
- Represented the North American Refractories Company (NARCO) asbestos trust in connection with a lawsuit filed by Honeywell in the U.S Bankruptcy Court for the Western District of Pennsylvania, resulting in Honeywell’s agreement to pay $1.325 billion to the trust.*
- Represented Official Committee of Talc Claimants of Imerys Talc America, Inc. in connection with all transactional and litigation matters with and against Imerys, its French parent entity, and its, indemnitor, Johnson & Johnson.*
- Represented special committee of the board of directors for Specialty Retail Shops Holding Corp. (ShopKo) in connection with the chapter 11 cases in the U.S. Bankruptcy Court for the District of Nebraska.*
