An article published in Law360 (subscription required) by attorneys in Ropes & Gray’s business & securities litigation and government enforcement practices examines the SEC’s efforts to amend some of the more controversial aspects of their administrative forum by amending its Rules of Practice governing the proceedings. The article provides an overview of the amended Rules of Practice and examines the ways in which a respondent might continue to be disadvantaged by the administrative forum as compared to a case brought in federal court.
