On the podcast “Agentic AI in Health Care: Regulatory Uncertainty, Federal Preemption, and Governance Strategies,” David discussed topics including how agentic AI differs from earlier forms of AI, why this difference is legally meaningful in health care, some significant use cases, issues related to federal preemption of state AI laws, enforcement risks and how health care organizations can respond, and the core elements of an effective AI governance framework that can adapt to the changing legal and regulatory environment.
David recently wrote an article on this topic in AHLA’s Health Law Weekly, co-authored by health care associate Jake Fulton.
