Tokyo Morning Briefing: Year 2012 in Review: Developments in U.S. Patent Litigation

The past year was another eventful one in U.S. patent law. A number of important decisions were reached that could have a significant impact on individual businesses and possibly even entire industries, including the Supreme Court’s rejection of patent-eligibility to certain medical diagnostic patents and expansion of standing to challenge FDA use codes, the Federal Circuit’s revised standard for induced infringement and doctrine of absolute intervening rights, and the Second Circuit’s refusal to enforce no-challenge clauses. 2012 was also the year when post-grant proceedings for challenging patents under the AIA took effect.
