Government Enforcement Partners Provide Guidance on Legal Privilege in Internal Investigations

Government enforcement partners Amanda Raad, Marcus Thompson (both of London) and Kim Nemirow (Chicago) discussed the ramifications of the recent United Kingdom case of Serious Fraud Office v. Eurasian Natural Resources Corporation Ltd., which limited the scope of legal privilege in internal investigations, in a July 12 webinar, titled “No Need to Overreact: A Few Practical Tips for Protecting Privilege in the U.S. and U.K. After the ENRC Decision.”

After an overview of legal privilege in internal investigations from U.S. and U.K. perspectives, Ms. Raad, Mr. Thompson and Ms. Nemirow discussed benchmarking of current practices for protecting privilege in internal investigations and compliance reviews, and provided participants with practical tips to consider in best preserving legal privilege in cross-border investigations and reviews.
