U.S./China IP and Trade Policy Trends

  • The U.S.-China trade relationship is crucial to the economic growth of both countries. In 2018, U.S. goods and services trade with China totaled an estimated $737.1 billion. The U.S.-China trade relationship supports roughly 2.6 million jobs in the United States across a range of industries. In this session, our seasoned panelists will discuss ways the relationship has evolved under the Trump administration, its implications or challenges for U.S. businesses with significant business interests in China, and strategies for addressing them.

International Trade Reforms

  • Tightening of U.S. oversight of overseas transactions, especially involving Chinese companies, has reverberated across global markets. In March 2018, the Committee on Foreign Investment in the United States (CFIUS) blocked Broadcom’s takeover of Qualcomm, citing national security concerns. In August 2018, the Senate passed the Foreign Investment Risk Review Modernization Act (FIRRMA), a sweeping change to the law governing CFIUS. Among other things, FIRRMA expanded the scope of transactions that are potentially subject to CFIUS review. The panel will explore risks posed by these changes, as well as strategies for dealing with those risks.

Trends in Global Cybersecurity and Privacy Policy

  • The GDPR, a comprehensive and sweeping privacy framework, went into effect in Europe in 2018. Simultaneously, China has been developing its own privacy and cybersecurity framework, and has already issued a number of legislative provisions regarding e-commerce. While the United States does not currently have a federal cybersecurity and privacy framework, several states, including California and New York, have taken steps to roll out state-level interventions, and Congress is expected to weigh in soon.
