Business & securities litigation partner Peter Welsh authored an article titled “M&A Litigation Goes Global” in the May issue of Insights: The Corporate & Securities Law Advisor. The author discusses the implications of the recent lawsuit Iron Workers Mid-South Pension Fund v. Focus Media Holding Ltd. et al. for foreign private issuers, private equity firms and others involved in global M&A. This case was the first time a shareholder plaintiff filed suit attempting to block a going-private transaction involving an issuer based in China and incorporated offshore with American depositary receipts traded in the U.S.
