Intellectual property litigation partner Peter Brody (Washington, D.C.) is quoted in Bloomberg BNA concerning the adoption of the Octane standard in trademark cases. Mr. Brody’s remarks follow the U.S. District Court for the District of Maryland’s opinion, issued on Jan. 26, in Teal Bay Alliances, LLC v. Southbound One, Inc. This is the latest court opinion to apply Octane to a Lanham Act case.
