Intellectual property litigation partner Peter Brody was quoted in a Bloomberg BNA article published in the Social Media Law & Policy Report on June 1. The article, titled “Justices Say Facebook Threat Prosecution Requires Proof Poster Had Criminal Intent,” analyses a case in which the Supreme Court overturned the criminal conviction of a Facebook user who was alleged to have made threats through the social media platform.

In the article, Brody clarifies that the ruling is consistent with long-established law concerning non-digital communications, and predicts that the first case directly tied to social media law to appear before the nation’s highest court will involve questions relating to the protected speech of employees under the National Labor Relations Act.
