Intellectual property litigation partner Andrew Thomases (Silicon Valley) has co-authored a Sedona Conference Working Group chapter titled “Commentary on Patent Litigation Best Practices: International Trade Commission Section 337 Investigations.”
Section 337 of the Tariff Act is a trade statute that permits the U.S. International Trade Commission to issue orders that prohibit the importation into the United States of articles that infringe intellectual property rights (such as patents, copyrights, or trademarks) or are otherwise connected to unfair acts.
The Sedona Conference chapter addresses topics including: interactions with the ITC’s Office of Unfair Import Investigations, discovery practices, Markman hearings and tutorials, ITC hearing procedures, petitions for review, and enforcement and modification of ITC orders, among other matters.
