Intellectual property partner Scott McKeown (Washington, D.C.) was quoted in a Mar. 19 article in Bloomberg Law’s Patent, Trademark & Copyright Journal. The article examines Purdue Pharma LP et al v. Collegium Pharmaceutical and how post-grant proceedings are approached in drug patent litigation.
The article explains circumstances in which post grant review may be leveraged to challenge patents. The article notes the use of post-grant reviews by the pharmaceutical industry, and that the number of filings could increase as more companies take advantage of the process.
Mr. McKeown discusses how pharmaceutical companies may approach the proceedings to combat patent ever-greening, and timing considerations to keep in mind when filing for a post-grant review.
