IP Attorneys Author Bloomberg Law Article Series on Emerging Global Trends in Standard-Essential Patent Litigation and Licensing

IP transactions counsel Regina Sam Penti (Boston & London) and IP litigation partner Kevin Post (New York) co-authored part one of a two-part series published June 15 by Bloomberg Law’s Big Law Business on emerging global trends in standard-essential patent (SEP) litigation and the availability of injunctions in Fair, Reasonable, and Non-Discriminatory (FRAND) cases.

The authors explain that the U.S., China and Europe all permit an SEP owner to seek an injunction against an infringer of FRAND-encumbered patents but the attitudes of the various courts toward injunctions differ, as do the conditions that must be met to obtain one. The authors present a survey of recent injunction cases and guidance issued by U.S., China and European courts.
