IP Litigator Examines Revised Procedures at the PTAB in The National Law Journal and Law360
In articles published Sept. 21 by The National Law Journal and Law360, IP litigation partner Scott McKeown (Washington, D.C.) examined recent procedural changes to the Patent Trial and Appeal Board.
Mr. McKeown explains that the creation of a Precedential Opinion Panel, comprised of the US Patent and Trademark Office Director and Under Secretary of Commerce, USPTO Commissioner of Patents, and Chief Judge of the USPTO Patent Trial & Appeal Board, solves several problems including that the PTAB was not issuing enough precedent to help practitioners. The Panel is also expected to replace the practice of using expanded PTAB judge panels.
