In The New York Times, IP Litigator Addresses the Use of Trademark Law in Motorcycle Club Racketeering Trial

IP litigation counsel Evan Gourvitz (New York) was quoted in an article published by The New York Times that examined how prosecutors are applying trademark law in the racketeering trial against the Mongols motorcycle club.

In the trial, federal prosecutors are attempting to seize the rights to the Mongols club logo and suppress its use. Mr. Gourvitz notes that “Trademark rights are not tangible personal property like a jacket. They are intangible rights. But prosecutors are treating a trademark like a jacket.”
