IP Litigator Provides 2019 PTAB Outlook in Law360
IP litigation partner Scott McKeown (Washington, D.C.) was quoted in a Jan. 1 Law360 2019 outlook article that examines what to expect after a year of change at the Patent Trial and Appeal Board.
Mr. McKeown explains that he would not be surprised to see the PTAB crack down on companies that file several petitions at the same time challenging the same patent. He also suggests the PTAB might consider adopting patent claim construction practices similar to the Markman procedures in district court.
