In Law360, IP Litigator Addresses Congress Overhaul of Patent Eligibility
IP litigation partner Scott McKeown (Washington, D.C.) was quoted in a Law360 article published on June 7 about U.S. Senate hearings that could lead to a re-write of the law on patent eligibility.
Mr. McKeown notes that the activity in the U.S. Congress is reminiscent of the passage of the 2011 America Invents Act that overhauled the patent system and created new ways to challenge patents.
In a recent Patents Post-Grant blog post, he explains that the best practice for patent owners is to preserve arguments if they think their patent could be susceptible to an eligibility challenge.
