Health Care Attorneys Examine Impact of U.S. Supreme Court Obamacare Decision

In Law360, a team of health care attorneys examined the U.S. Supreme Court decision in Maine Community Health Options v. United States. The court ruled that the federal government has an obligation to pay insurance companies approximately $12 billion under the Risk Corridors Program of the Patient Protection and Affordable Care Act.

The authors explain that the ruling is a major victory for insurers who participated in health benefit exchanges. They note that insurers will face additional legal and financial questions as they endeavor to collect the Risk Corridors Program payments owed to them and may attempt to extend the decision in pending and future litigation.
