Leveraged finance partner Alyson Gal co-authored a chapter in the International Comparative Legal Guide on the topic of public investment funds in 2022.
Entitled Public Investment funds Law and Regulations Credit Facilities for Registered Investment Funds 2022, the chapter looks closely at the issues and concerns that registered fund borrowers may encounter as they seek to enter into a credit facility.
She discusses the use of credit facilities as regulated by Section 18 of the Investment Company Act of 1940, and the differing requirements for open-end as opposed to closed-end funds.
