Health care partner and co-chair Deborah Gersh and health care associates Cara Dermody and Chandler Gray co-authored a Law360 article that discusses privacy guidance related to reproductive health care following the U.S. Supreme Court Dobbs decision stating that state legislatures have the authority to regulate abortion.

The attorneys note that health care providers should ensure that their workforce understands when HIPAA privacy rule guidance does not permit the disclosure of protected health information, even if requested by a law enforcement official. In addition, health care providers must comply with the federal Emergency Medical Treatment and Active Labor Act, even when doing so conflicts with state statutes and regulations.
